Terms of Service

These terms govern your use of BankAnalysis, including the web app, AI features, subscriptions, the read-only ChatGPT app, and the MCP connector.

Agreement to these terms

These Terms of Service are a legal agreement between you and BankAnalysis, Inc., referred to in these Terms as BankAnalysis, we, us, or our. By accessing or using BankAnalysis, you agree to these Terms. If you use BankAnalysis on behalf of an organization, you represent that you have authority to bind that organization.

The service

BankAnalysis provides software for researching U.S. banks and holding companies, including financial data, public filings, earnings-call transcripts, news, comparison tools, AI-assisted analysis, exports, and authenticated read-only access through MCP-compatible clients such as ChatGPT.

We may change, suspend, or discontinue parts of the service as the product evolves. Some features may be labeled beta, preview, or early access and may be less reliable than generally available features.

The BankAnalysis MCP connector is read-only. It does not create, modify, delete, purchase, trade, submit, or approve information on your behalf.

Geographic availability

BankAnalysis is operated from the United States and is intended primarily for users located in the United States. We may limit, suspend, or terminate access from locations outside the United States, or where providing the service would create legal, tax, regulatory, security, or operational risk.

Sanctions and export controls

You may not use BankAnalysis if you are located in, ordinarily resident in, organized under the laws of, or acting on behalf of a country, region, person, or entity subject to U.S. sanctions or trade restrictions. You may not use BankAnalysis in violation of U.S. export-control or sanctions laws.

Accounts and access

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate account information and promptly update it if it changes. We may limit, suspend, or terminate access if we reasonably believe your account has been compromised, violates these Terms, or creates risk for BankAnalysis or others.

You may use BankAnalysis only if you are at least 13 years old and legally able to agree to these Terms. If you are under the age of majority where you live, you may use BankAnalysis only with consent of a parent or legal guardian.

Google sign-in and connected apps

If you use Google sign-in, Google may provide basic account information to help us authenticate you. If you connect BankAnalysis to ChatGPT or another MCP-compatible client, that client may send authenticated requests to BankAnalysis and receive data returned by BankAnalysis on your behalf. Your use of Google, ChatGPT, and other third-party services is also governed by their terms and policies.

Acceptable use

You agree not to:

  • Use BankAnalysis in violation of law or third-party rights.
  • Attempt to bypass access controls, rate limits, billing controls, or security measures.
  • Reverse engineer, scrape, or overload the service except as allowed by law or written permission.
  • Upload malicious code or interfere with the operation of BankAnalysis.
  • Use the service to build or train a competing product without our written permission.
  • Misrepresent AI outputs, data sources, or BankAnalysis-generated analysis as independently audited or verified work product.

Financial information is not advice

BankAnalysis is provided for informational and research purposes only. It does not provide investment, legal, accounting, tax, regulatory, credit, lending, or risk-management advice. You are responsible for independently verifying outputs, source data, assumptions, and conclusions before using them for any decision.

BankAnalysis is not a broker-dealer, investment adviser, credit rating agency, bank, lender, accounting firm, or law firm. BankAnalysis does not make investment recommendations, credit decisions, lending decisions, regulatory determinations, or risk-management decisions.

AI outputs and data accuracy

AI-generated responses may be incomplete, outdated, inaccurate, or inconsistent with source material. Financial data, filings, transcripts, market data, news, and metrics may contain errors, delays, gaps, provider limitations, or interpretation issues. You should verify important information against primary sources and your own professional judgment.

Your content

You retain ownership of prompts, feedback, saved replies, and other content you submit to BankAnalysis. You grant BankAnalysis the rights needed to host, process, transmit, display, and use that content to provide, secure, support, and improve the service, consistent with our Privacy Policy.

You represent that you have the rights needed to submit content to BankAnalysis and that doing so does not violate law, confidentiality obligations, or third-party rights.

Third-party data and services

BankAnalysis may rely on third-party or public sources, including government data, market data, news, filings, transcript providers, payment processors, hosting providers, analytics providers, AI providers, and authentication providers. We are not responsible for third-party services, data availability, source errors, or provider policy changes.

Subscriptions and billing

Paid plans, if available to your account, are billed through our payment processor. Fees, renewal periods, included usage, and plan limits are shown at checkout or in the product. Unless stated otherwise at checkout or required by law, fees are non-refundable. You are responsible for taxes and for keeping billing information current.

Subscriptions automatically renew unless canceled before the renewal date. You can cancel by contacting support@bankanalysis.ai. If self-service cancellation is available in your account page, you may also cancel there. Cancellation stops future renewals but does not automatically refund past charges, except where required by law or expressly stated at checkout. If payment fails, we may suspend, downgrade, or terminate access.

Intellectual property

BankAnalysis and its software, design, trademarks, workflows, and documentation are owned by BankAnalysis or its licensors. These Terms do not grant you ownership of BankAnalysis intellectual property. You may use the service only as permitted by these Terms.

Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal data. By using BankAnalysis, you acknowledge the Privacy Policy.

Disclaimers

BankAnalysis is provided on an as-is and as-available basis without warranties of any kind, whether express, implied, or statutory. We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, BankAnalysis will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Our total liability for claims related to the service will not exceed the greater of $100 or the amount you paid BankAnalysis for the service in the three months before the event giving rise to the claim.

Indemnity

You agree to defend, indemnify, and hold harmless BankAnalysis from claims, damages, liabilities, and expenses arising from your use of the service, your content, your violation of these Terms, or your violation of law or third-party rights.

Termination

You may stop using BankAnalysis at any time and may delete your account when eligible. We may suspend or terminate access if you violate these Terms, create risk, fail to pay amounts owed, or if we discontinue the service.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, unless applicable law requires otherwise.

Changes to these terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating this page or providing an in-product notice. Your continued use of BankAnalysis after changes become effective means you accept the updated Terms.
